Terms of Service Last Updated: 16th May 2025

Placing and paying for an order constitutes your agreement to follow and be bound by these Terms of Service.

Persons under the age of 18 are not permitted to make purchases from Fenner Benedict without prior agreement.

Definitions:

I am: Fenner Benedict trading as 'Fenner Benedict' and 'Fenner Benedict Handmade' (herein referred to as ‘Fenner Benedict’, ‘I’, or ‘me’)

You are: A customer of Fenner Benedict (herein referred to as ‘you’ or ‘your’)

The price that you pay for any goods or services are as advertised at the specific time and outlet through which you are making your purchase. Fenner Benedict reserves the right to advertise the same goods elsewhere at different prices - this may be due to differing commission rates and / or special promotions.

In the case of items ordered directly from Fenner Benedict, any quoted price will remain valid for 7 calendar days from the date of the quote - this includes quotations sent by email.

Fenner Benedict reserves the right to advertise promotional offers and discounts through any outlet and at any time without prior notification.

1.2 Terms of Payment

Fenner Benedict will accept payment for goods and services by Shopify Payments or PayPal. Payments can also be made by BACS transfer with prior agreement.

Quotes will remain valid for 14 days. In all circumstances, work will only be undertaken or goods despatched on orders that have been paid in full and once payment has been verified as valid and lawful. Payment for bespoke products or customised goods will be required in full before work on the order begins and payment of all invoices will be required within 7 days of the date of issue.

All prices quoted (unless otherwise stated or converted using website currency conversion tools) are in Pound Sterling (£ / GBP). Fenner Benedict is not currently VAT registered and therefore VAT is not applicable to any quoted prices.

1.3 Delivery and Postage

Please see the Shipping Policy page for full details of despatch times and postage information.

Fenner Benedict can accept no liability for the delay of orders due to circumstances beyond my control including the delay of supplies or materials delivery to myself or delays as a result of postage / courier delays.

Parcels may require a signature upon delivery. Orders may be split into two or more parcels on occasion.

Postage prices for bespoke orders and high-value orders are by quotation.

Claims for lost parcels can only be made after the time specified in the terms of the courier or postal service used to send the parcel. A parcel cannot be considered 'lost' until the courier or postal service has processed the claim for the same and as such refunds will only be given for lost parcels following the completion of a compensation claim with the courier or postal service. Fenner Benedict cannot be held liable for any consequential loss resulting from delayed or lost parcels.

In the unlikely event of a lost or damaged parcel, Fenner Benedict and the courier / postal service must be informed immediately. In the case of a damaged parcel, photographic evidence will be requested to assist with a compensation claim - this will be needed before any claim process can commence.

1.4 Information on Import Duty (Applicable to orders from outside the United Kingdom):

Please note that all shipments outside of the United Kingdom, including those sent to the Channel Islands, Republic of Ireland, and EU countries may be subject to Import Duty / TAX / VAT as well as handling fees which are applied once a shipment reaches your country as all goods are Delivered Duty Unpaid.

I have no control over these charges and am unable to predict what they may be. These charges are the sole responsibility of the customer as the importer and under no circumstances will Fenner Benedict be responsible for the payment of these charges. Customs clearance charges and handling fees must be paid for by the importer of the goods.

I am not able to offer a refund for returned goods which are returned because the customer wishes to avoid paying any customs duties imposed.

When ordering from Fenner Benedict outside of the UK, you agree to pay any Import Duty / Tax / VAT and handling fees which may be imposed by your country's government. If you refuse to pay any Import Duty / Tax / VAT and handling fees imposed and thereby prevent delivery of your order you will remain liable for the purchase price of the product(s) and any Import Duty / Tax / VAT or penalty imposed by your government.

In addition, items sent overseas may be subject to random checks which may cause associated delays and additional charges. Fenner Benedict is not responsible for any delays or charges imposed by your countries government or other agencies.

2.0 Representation and Specification of Goods

2.1 General Specification Info

The specific details given within product listings and descriptions provide additional information which should be noted. All specification information is given in good faith however Fenner Benedict cannot be held liable for any mistakes or minor inaccuracies present within product descriptions.

2.2 Photography and Colour Reproduction

Due to the limitations of photography colour reproduction and computer screen display colour differences, the actual colour, shade or tone of any product may differ slightly from that shown within product photographs. All efforts are made to visually represent products as accurately as possible however Fenner Benedict cannot be held responsible for slight variations in actual colour. Product photographs are not shown at actual sizes unless stated.

2.3 Natural Materials and Hand-finishing

Due to the inevitable variations present within leather as a natural product it is possible that the colour, shade and finish of leathers may differ from product to product even when made from the same leather hide or batch. Leather products that have been dyed or oiled by hand are also subject to tonal differences from the example products shown - dying leather by hand is an art not a science and as a result no two pieces are ever totally the same shade. As leather is a natural product it is likely to contain scars and other natural markings - these markings and variations in the leathers grain, structure, finish or thickness are not considered to be faults as leather is a natural material.

3.0 Returns and Customer Service

3.1 Order Returns Policy - Standard Products

In compliance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, any goods that have not been made to a customers specification can be returned in their original unused condition provided that Fenner Benedict is notified within 14 calendar days of the receipt of your order. Unless the product is faulty, the buyer will be financially responsible for the safe return of any item using an appropriate postage service.

For clarification purposes, a 'fault' consists of any defect not consistent with the nature of the product or materials used. Natural scars, markings, dents and finish irregularities are consistent with the natural qualities of leather and it's worked nature and therefore do not constitute faults.

In order to return an item you need to email Fenner Benedict with notice of your intent to return the item along with the reason for your return. Please do not post the return until you have received a reply.

If you are considering a return please email first explaining the reason / issue as it may be possible to resolve the problem without the need to return the product.

3.2 Order Returns Policy - Bespoke and Personalised Products

In compliance with UK trading law, any goods that have been personalised or made to a customer's specifications will be classed as ‘bespoke’ and are not, under any circumstances, eligible for returns or refunds - this is because the item will not be resalable. This includes items that have been commissioned, goods that have been modified or personalised by means of any physical alteration to a standard product, no matter how small this may be - this includes, but is not limited to; the addition of non-standard clasps etc. or the addition of embossed or laser engraved initials or monograms.

Making payment for goods that are ‘bespoke’ constitutes your agreement to follow and be bound by these Terms and Conditions.

3.3 Order Returns Policy - Body Piercing Jewellery

For reasons of hygiene, I am unable to accept returns on any body piercing jewellery (e.g. earrings) that have been removed from their sealed plastic hygiene packaging.

3.4 Customer Service and Contacting Fenner Benedict

In the unlikely event that you are not happy with any product or service from Fenner Benedict, I ask that your complaint be sent by email in order to allow me to resolve any issues to your full satisfaction.

I kindly request that you please do not use online feedback or reviews to make complaints - it is unfair to leave a potentially detrimental feedback comment without first giving me the opportunity to resolve any issues or problems - I will always work to resolve any issues as quickly as possible and with as little inconvenience to the customer as possible.

4.0 Data Protection and Privacy

4.1 Customer Data Protection

It is necessary for certain customer details to be used by Fenner Benedict for the purposes of processing orders and communicating with customers. The most commonly used data is; customer name, email address, postal address and telephone number. Data may also include details relating to payment methods.

Any personal information you give to Fenner Benedict will always be processed in accordance with the UK Data Protection Act 2018. I will only use the personal information you provide to deliver the services you have requested, or for my lawful, disclosed purposes. I will not make your personal details available outside my organisation without your consent unless obliged to by law.

5.0 Liability and Legal

5.1 General Liability

I do not accept liability for any typographical, clerical or other errors and/or omissions and reserve the right to add to, delete from, and modify any of the information found on the Fenner Benedict website and as published elsewhere at any time and without notice.

Subject to the following provisions Fenner Benedict warrants that any products supplied will correspond with any applicable specification at the time of delivery and will be free from defects in material and workmanship for a period of twelve months from delivery. This warranty is given subject to the following conditions:
1. Fenner Benedict shall be under no liability in respect of any defect in the products arising from any specification or instructions by you or errors or inadequacies in the same.
2. Fenner Benedict shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage or alteration or repair of products without prior approval from Fenner Benedict - For clarification, the term 'fair wear and tear' in this context is used to describe any aesthetic or physical alteration/change to the product consistent with the specification, quality and type of materials and finishes used.

Where Fenner Benedict has replaced or repaired defective products or products failing to meet specification or refunded to you the price of such products (or a proportionate part of the price), Fenner Benedict shall have no further liability to you.

5.2 Liability for Pattern/Template Items

If you are sending me a pattern item (for example a specific pen to make a case for) then it is your responsibility to ensure that the pattern item is sent to me by an appropriate method with adequate insurance cover.

Whilst I do of course take every care of items in my possession I cannot be held liable for any accidental damage caused to a pattern item whilst in my care. In the very unlikely event that a pattern item becomes damaged whilst in my possession then I will only be able to cover the cost up to a maximum of the value of the order you have placed with me. It is your responsibility to ensure that your pattern item is covered under your own insurance before you send it to me.

I will return your pattern item to you once I have made the product that it was required for. Both pattern item and Fenner Benedict products will be returned using a service appropriate for the combined value of the items. This is likely to incur extra postage charges which will be included in the quote.

5.3 Liability resulting from the use of Fenner Benedict products

Under no circumstances will Fenner Benedict be held liable for any damage to property or injury to persons resulting from the use of any Fenner Benedict product or from the use of any Fenner Benedict product contra to their intended purpose or contra to any special instructions or information made available at the time of purchase.

I cannot accept claims for consequential loss or for damage to property or persons resulting from the use of my products. This includes (but is not limited to) the following:
- Scratches, marks or damage to objects or property caused by metal hardware or fittings on any Fenner Benedict product.
- Injury to persons from contact with metal hardware, fittings or any part of any Fenner Benedict product.
- Loss of or damage to property or personal injury resulting from disengagement when attached or connected to any Fenner Benedict product.
- Transfer of dye, oil or finish originating from any Fenner Benedict product onto skin, clothing, surfaces, furnishings or property.

5.4 Legal Statement

All products sold by Fenner Benedict shall remain the property of Fenner Benedict until payment of the total product invoice amount.

The instruction of an order is bound under the Consumer Rights Act 2015 and is made between Fenner Benedict and you as the purchaser. Fenner Benedict does not endorse the resale of any product purchased from Fenner Benedict and will not enter into any discussion about an order with any persons other than the original purchaser.

You undertake that all details you provide for the purpose of ordering or purchasing products (including any specifications or dimensional requirements) are correct and that you have access to sufficient funds to cover the cost of the order.

If there are any changes to the details supplied to me by you it is your responsibility to inform Fenner Benedict within a reasonable period after supply of such details. I shall have no liability to you arising from your failure to do this.

Confirmation of receipt of your order by e-mail, does not guarantee the product sale. A sale is only deemed complete when payment has been made in full and as such products or materials can be sold to another party prior to you having made payment in full. It is for this reason that it is essential that you complete your order by making payment as soon as practically possible.

Fenner Benedict reserves the right to add to, delete from, and modify these Terms of Service at any time without any prior notice. You are reminded to check these Terms of Service for each purchase you make.
